The lawyers at Sauer Roldskov Law Firm was appointed by the Ministry of Justice in Denmark and is part of the Law Society. The lawyers at Sauer Roldskov covered by professional supervisory and disciplinary system and the rules of professional discipline in accordance with Code of Civil Procedure § 126th In addition, the Code of Conduct for the Danish Bar and Law Society applies. Rules specifically governing the exercise of the lawyer profession can be found on the Bar and Law Society website www.advokatsamfundet.dk.
These terms and conditions of Sauer Roldskov, including stipulations on governing law and venue, shall apply to any legal service and/or advice provided by Sauer Roldskov unless otherwise agreed in writing.
1. Receipt of an assignment
Upon receipt of an assignment we, in accordance with the rules of the Danish Bar and Law Society as well as Sauer Roldskov’s own guidelines, make sure that no potential or actual conflicts of interest exist.
2. Providing legal advice
Sauer Roldskov conducts services in accordance with the Danish Administration of Justice Act, the code of ethics for attorneys laid down by the Danish Bar and Law Society and other applicable laws.
Sauer Roldskov is subject to the law on measures to prevent money laundering and financing of terrorism and has the duty to collect and store identity information of the client.
3. Use of legal advice
The legal advice of Sauer Roldskov is limited to the specifically agreed purposes and can not be used for other purposes, unless otherwise agreed separately.
4. Fees, disbursements, payment terms and client funds
Our fee is determined by a number of parameters, particularly the time and specialist knowledge required, and taking into account the values, nature and outcome of the case, the importance of the case and the responsibility associated with the solving of the assignment.
Sauer Roldskov invoices our clients for any necessary costs / disbursements connection with the service provided, including reasonable travel and living expenses and copying fees.
Sauer Roldskov issues invoices on a monthly basis. Invoices are due for payment 14 days from date of invoice. Late payments are subject to interest pursuant to Danish law.All client funds entrusted to Sauer Roldskov are managed in accordance with the rules of the Danish Bar and Law Society.
6. Confidentiality
All employees of Sauer Roldskov are subject to a duty of confidentiality. Any information received in connection with an assignment is treated as confidential unless otherwise agreed.
7. Liability, limitation of liability and insurance
Sauer Roldskov shall be liable towards the client only. Sauer Roldskov shall be liable for our advice and services in accordance with Danish law, however, Sauer Roldskov shall not be liable for any consequential financial loss and other indirect loss, including loss of data, lost profits, loss of profits, goodwill, etc.
Sauer Roldskov has mandatory liability insurance in a reputable insurance company, Tryg, which insurance covers our advice concerning legal matters under Danish law. The annual insurance cap per attorney for professional liability is DKK 15,000,000.00. Sauer Roldskovs liability towards one client per assignment shall be limited to DKK 7,500,000.00. Sauer Roldskovs total liability towards one client per two consecutive calendar years shall at all times be limited to DKK 15,000,000.00. Sauer Roldskov has also provided a guarantee in accordance with the rules of the Danish Bar and Law Society.
Sauer Roldskov shall not be liable for acts or omissions of any consultants, advisors or contractors, to which Sauer Roldskov have referred the client, or to whom any part of an assignment has been subcontracted in agreement with ours clients.
8. Applicable law and jurisdiction
Sauer Roldskov’s advisory services and these terms and conditions are subject to Danish law and any dispute between Sauer Roldskov and a client must be resolved in accordance with Danish law by a competent Danish court.
